California’s Proposition 46 Fails

California’s Proposition 46 did not pass after yesterday’s midterm elections. Prop 46 would have raised the state of California’s cap on medical malpractice pain and suffering damages from $250,000 (the limit set in 1975) to $1.1 million. The proposed increase was meant to account for inflation since the establishment of the current cap nearly forty years ago.
